1. INTRODUCTION

1.1. An Easy English version of these terms is available here.1.2. Housing Hub (ABN 14 663 443 758) (“Housing Hub”, “we”, “us”) operates a Website and matching platform accessible at www.housinghub.org.au (“Website”), that enables providers of accessible housing and housing-related services ("Providers", “you”), to offer those properties and services to individuals who are looking for accessible housing or related services ("Seekers", “Supporters”, “you”).1.3. Our Privacy Policy forms part of these Terms of Use (“Terms”).  When you use our Website, you agree to be bound by these Terms. 1.4. Consent: If you do not or cannot agree to these Terms, you must stop using our Website immediately.1.5. Age Limits: Individuals under the age of 18 may use the Website to access information, but may not use the Website to search for housing and related services.1.6. Clauses 4, 5, 6, and sub-clause 7.5 of these Terms do not apply to Seekers and Supporters. Clause 3 of these Terms does not apply to Providers.

2. SCOPE OF HOUSING HUB WEBSITE

2.1 Role: Housing Hub solely provides the Website. We do not review or moderate Providers or Listings, and we do not inspect any housing that is the subject of a Listing.2.2 No Guarantees: We do not represent or guarantee: the accuracy of descriptions; the suitability of a property to an individual; the performance of Providers; or the past/future performance of Providers.2.3 Connection Only: Our role is to connect Providers with Seekers and Supporters through the Website.2.4 User Assessment: It is the sole responsibility of Seekers and Supporters to make their own assessment of suitability, including inspecting housing and meeting with tenants or Providers.2.5 Third-Party Agreements: Housing and service arrangements must be set out in a clear tenancy, sale, or service agreement. We are not a party to any agreement entered into between a Seeker/Supporter and a Provider.

3. SEEKER AND SUPPORTER REGISTRATION

3.1 Free Access: Access is provided free of charge and can be used anonymously.3.2 Seeker Accounts: You can create a "Seeker Account" to receive a personalised experience, provide a "Seeker Profile," and receive automatic alerts.3.3 Supporter Accounts: If searching for another person, you can create a "Supporter Account" to manage multiple profiles. You may only create a profile for another person with their express consent.3.4 Suitability Score: This score is general in nature, relies on the accuracy of user-provided information, and is not a recommendation or endorsement by us.

4. PROVIDER REGISTRATION AND SUBSCRIPTIONS

4.1 Eligibility: Individuals registering as Providers must be over 18 years of age. We may refuse an application for registration at our absolute and reasonable discretion.4.2 Subscription Requirement: Access to the Website is made available on a subscription basis for Providers. You must select a Plan, pay fees, and provide the required information before access is granted.4.3 Plan Services: The Plan determines the services you can access. Providers may use the Website to offer properties for sale or lease ("Property Listing") or offer housing-related services ("Provider Listing").4.4 Free Trials: If granted a trial, you may cancel anytime before the end of the trial without charge. If not cancelled, you will be automatically charged. Trial periods end immediately if you change your Plan.4.5 Renewals: Upon expiry, Plans automatically renew for the same period unless you have selected a new Plan or notified us of cancellation.4.6 Billing Management: The billing contact is the email entered via Stripe; this contact has permissions to manage subscriptions. You are responsible for keeping this address accurate.4.7 Renewal Notices: Failure to receive renewal notices due to outdated contact details does not affect automatic renewal or create a refund entitlement. You remain responsible for monitoring renewal dates.4.8 Refunds: Fees paid for subscription Plans are non-refundable. Cancellation during a term does not result in a refund for the unused portion, and access continues until the end of that term. Discretionary refunds may be approved in exceptional circumstances.4.9 Plan Changes: Upgrades take effect immediately; unused portions of current Plans are applied as credit.
  • For downgrades, you will be charged the difference in value.
  • If a new Plan has fewer entitlements, you must unpublish listings manually, or we will automatically unpublish the oldest listings first to meet the new limit.
4.10 Variations: We may vary services or fees at any time, providing 30 days' notice for fee increases on your current Plan. Third-party transaction costs may be passed on to you.

5. LISTING INTEGRITY

5.1 Permitted Properties: You may only list real property permanently attached to land that has been constructed or modified with accessible features. Listings for transportable structures, vehicles, personal assets, or non-housing business services are strictly prohibited.5.2 Accuracy of Information: Providers must ensure all published property details, pricing, leasing costs, structural accessibility data, and availability statuses remain accurate, up to date, and compliant with the Material Standards outlined in Clause 7.4.5.3 Discretionary Removal and Amendment: We reserve the right, at our absolute and sole discretion, to remove, unpublish, suspend, or amend any Property Listing or Provider Listing at any time, without prior notice, if we believe the listing is inaccurate, misleading, violates Clause 7, or otherwise fails to comply with the intent of these Terms.

6. SPECIALIST DISABILITY ACCOMMODATION (SDA) PROPERTY LISTINGS

6.1 Data Sharing: We share details of published SDA dwellings with the NDIA regularly.6.2 Consent: By listing an SDA dwelling, you consent to this data sharing.6.3 Accuracy: You must keep property addresses and ABNs up to date to comply with NDIA matching requirements.6.4 Confirmation: It is your responsibility to ensure you receive confirmation of data receipt from the NDIA.6.5 Notice to Stop: We may stop providing this data to the NDIA with 30 days' notice.

7. YOUR OBLIGATIONS

7.1 Compliance: You must comply with these Terms at all times.7.2 Security: You must maintain the confidentiality of login credentials and are responsible for all activities using those credentials.7.3 Third-Party Consent: You must have consent before providing personal information about another person to us.7.4 Material Standards: Information ("Material") must be up to date and must not: be harmful, false, or infringing on IP; violate any law (consumer protection, anti-discrimination); be defamatory, offensive, or obscene; contain nudity or viruses; or contain professional advice.7.5 Provider Specifics: Providers must: comply with all laws/licensing; have authority to sell/lease; not charge additional fees beyond those specified in your Property Listings, Provider Listing and any tenancy, sale or service agreement that you enter into with a Seeker; and perform all obligations to Seekers promptly (responding to queries, assessing tenants).7.6 Confidentiality: If your Plan provides access to Confidential Information (market data), you will not share it.

8. INTELLECTUAL PROPERTY

8.1 Ownership: Housing Hub owns the Website, code, matching algorithms, logos, and market data ("Confidential Information").8.2 Restrictions: You must not copy, publish, or exploit content. No automated scraping, reverse engineering, or decompiling is permitted.8.3 Licence: By making Material available, you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, and communicate it.

9. THIRD PARTY WEBSITES, ADVERTISING AND ACTIVITIES

9.1 Control: Third-party links are not under our control, and you use them at your own risk.9.2 Endorsements: Third-party advertising does not constitute a recommendation or endorsement by us.9.3 Google Maps: Use of map functionality is subject to Google Maps terms and conditions.

10. LIMITATION OF LIABILITY

10.1 Disclaimers: To the extent permitted by law, we disclaim all liability for loss arising from transactions between Seekers and Providers.10.2 "As Is": Our Website is provided on an "as is" basis without implied warranties of title, merchantability, or fitness for purpose.10.3 Statutory Rights: This does not exclude Non-excludable Conditions under the Competition and Consumer Act 2010 (Cth). Our liability for such conditions is limited to re-performing the obligation or the cost thereof.

11. INDEMNITY

11.1 General: You agree to indemnify us against any third-party claims arising from your use of the Website or Material you provided, except where caused by our fraud or negligence.11.2 Mitigation: We will take reasonable steps to mitigate loss, and your liability will be reduced proportionately to the extent we contributed to the loss.

12. CHANGES TO THESE TERMS

12.1 Modifications: We may modify services or Terms at any time.12.2 Acceptance: Continued use of the Website constitutes acceptance of amended Terms.

13. NOTICES

13.1 Delivery: We will send notices through your account or email.13.2 Hub Contact: Notices to us must be sent to support@housinghub.org.au.

14. TERMINATION

14.1 Cancellation: You may cancel at any time. We may cancel immediately for non-payment (30 days late), material breach, insolvency/bankruptcy, death/dissolution, or reasonable concerns based on complaints.14.2 Timing: Termination takes effect at the end of the term unless terminated earlier for material breach. Fees remain non-refundable.14.3 Post-Termination: Listings will be removed after the termination date. Termination does not affect existing sale/tenancy agreements between users.14.4 Survival: Clauses 2, 8, 10, and 11 survive termination.

15. GENERAL

15.1 Jurisdiction: Governed by the laws of Victoria, Australia.15.2 Severability: Invalid provisions may be removed without affecting the remaining terms.15.3 Assignment: We may assign our rights; you require our prior written consent to assign yours.
