New information was released last week about changes to eligibility for unscheduled plan reviews. This confirms that unscheduled plan reassessments will only be possible when:
While this clarification is helpful, there is still uncertainty about how these criteria will be applied in practice for NDIS participants seeking an unscheduled review of their home and living funding.
What is clear is that once the amendment becomes law, the new criteria will take effect within 7 days. Any active unscheduled plan reviews at that time will be assessed against these requirements.
It is also important to note that the NDIS is extending its timeframe for deciding whether to review a plan from 21 days to 90 days. This will likely increase the time participants wait for a decision.
For this reason, we recommend that anyone submitting an unscheduled plan review clearly explains how their situation meets these criteria. This should be outlined in the supporting evidence, including the Change of Situation form.
