ABOUT THIS WEBSITE

Housing Hub (ABN 14 663 443 758) runs this website: www.housinghub.org.au.The website and matching platform help connect:
  • people looking for accessible housing or housing-related services, including Seekers and their supporters
  • people or organisations offering accessible housing or housing-related services, called Providers.
The Housing Hub Privacy Policy is part of these terms.By using the website, you agree to these terms. If you do not agree, or you cannot agree, you must stop using the website immediately.If you are under 18 years old, you may use the website to read information only. You must not use the website to search for housing or services.Some parts of these terms apply only to Providers. Some parts apply only to Seekers and supporters.

WHAT HOUSING HUB DOES

Housing Hub provides the website and matching platform only.Housing Hub does not:
  • review, approve or moderate Providers or listings
  • inspect any housing that is listed
  • guarantee that descriptions, prices, photos or other information are correct
  • guarantee that a property or service is suitable for a person
  • guarantee how a Provider has performed or will perform
  • become part of any tenancy, sale or service agreement between users
Housing Hub helps connect Providers with Seekers and supporters. It is the responsibility of Seekers and supporters to decide whether a property or service is suitable.Seekers and supporters should make their own checks. This may include inspecting housing, meeting with Providers or tenants, and getting advice where needed.Housing, sale and service arrangements must be recorded in a clear agreement between the relevant users. Housing Hub is not a party to those agreements.

SEEKER AND SUPPORTER ACCOUNTS

Seekers and supporters can use the website for free. They can also use the website anonymously.A Seeker can create a Seeker Account to:
  • receive a more personalised experience
  • create a Seeker Profile
  • save searches
  • receive automatic alerts
  • receive a Suitability Score.
A supporter can create a Supporter Account to search for another person and manage more than one profile. A supporter must only create a profile for another person if that person has clearly agreed.The Suitability Score is a general guide only. It depends on the information users provide. It is not a recommendation, approval or endorsement by Housing Hub.

PROVIDER ACCOUNTS AND SUBSCRIPTIONS

Providers must register before they can use Provider features on the website.A person registering as a Provider must be over 18 years old.Housing Hub may refuse a Provider registration at its absolute and reasonable discretion.Providers must choose a subscription plan, pay the required fees and provide the required information before they can access Provider services.The subscription plan sets out what services the Provider can use. Providers may use the website to list properties for sale or lease, or to list housing-related services. Free trialsIf Housing Hub gives a Provider a free trial:
  • the Provider can cancel before the trial ends without being charged
  • if the Provider does not cancel before the trial ends, the Provider will be automatically charged
  • the trial ends immediately if the Provider changes plans.
Renewals and billing
  • When a subscription period ends, the plan automatically renews for the same period unless the Provider chooses a new plan or tells Housing Hub they want to cancel.
  • The billing contact is the email address entered through Stripe. This billing contact can manage the subscription.
  • Providers are responsible for keeping billing contact details accurate.
  • If a Provider misses a renewal notice because their contact details are out of date, the plan may still renew and the Provider is not automatically entitled to a refund.
  • Providers are responsible for monitoring their renewal dates.
Fees, refunds and plan changes
  • Subscription fees are non-refundable, unless Housing Hub decides to approve a refund in exceptional circumstances.
  • Cancelling during a subscription period does not give a refund for the unused part of that period. Access continues until the end of the paid period.
  • Upgrades take effect immediately. Any unused part of the current plan may be applied as a credit.
  • For downgrades, the Provider may be charged the difference in value.
  • If a new plan allows fewer listings, the Provider must unpublish extra listings. If they do not, Housing Hub may automatically unpublish the oldest listings first.
  • Housing Hub may change services or fees at any time. Housing Hub will give 30 days notice before increasing fees for a Provider's current plan. Third-party transaction costs may be passed on to Providers.

PROPERTY LISTINGS

Providers may only list real property permanently attached to land that has been built or changed to include accessible features. Providers must not list boats, caravans or non-housing-related business services.Providers must ensure property details, pricing, leasing costs, accessibility data, and availability statuses remain accurate, up to date, and compliant.Providers must not remove and republish a listing only to make it appear newHousing Hub may remove or change listings that do not follow these terms.

SDA PROPERTY LISTINGS

Housing Hub regularly shares details of published Specialist Disability Accommodation (SDA) dwellings with the National Disability Insurance Agency (NDIA).By listing an SDA dwelling, the Provider agrees to this data sharing.Providers must keep property addresses and ABN details up to date so the information meets NDIA matching requirements.Providers are responsible for making sure they receive confirmation that the NDIA has received the data.Housing Hub may stop providing this data to the NDIA by giving 30 days notice.

YOUR RESPONSIBILITIES

Everyone using the website must:
  • Follow these terms at all times
  • Keep login details confidential and secure
  • Take responsibility for activity that happens through their login details
  • Get consent before giving Housing Hub personal information about another person.
Any information, photos, listings or other material provided to Housing Hub must be up to date and must not:
  • Be harmful, false or misleading
  • Breach intellectual property rights
  • Break any law, including consumer protection and anti-discrimination laws
  • Be defamatory, offensive or obscene
  • Include nudity
  • Include viruses or harmful software
  • Include professional advice.
Providers must also:
  • Follow all relevant laws and licensing rules
  • Have authority to sell or lease the property they list
  • Not charge extra fees beyond what is in the listing
  • Respond to Seeker enquiries promptly
  • Assess tenants and perform other obligations to Seekers promptly.
If a Provider Plan gives access to confidential information, including market data, the Provider must not share that information.

INTELLECTUAL PROPERTY

Housing Hub owns the website, code, matching algorithms, logos and market data.Users must not:
  • copy, publish or exploit website content
  • use automated scraping tools
  • reverse engineer, decompile or copy the website systems.
If a user makes material available on the website, the user gives Housing Hub a perpetual, worldwide, royalty-free licence to use, copy, reproduce and communicate that material.

THIRD-PARTY WEBSITE AND ADVERTISING

The website may include third-party links or advertising.Housing Hub does not control third-party websites. Users use them at their own risk.Third-party advertising does not mean Housing Hub recommends or endorses the advertised goods or services.Use of map features is subject to Google Maps terms and conditions.

LIMITS OF LIABILITY

To the extent permitted by law, Housing Hub is not responsible for loss arising from transactions or agreements between Seekers, supporters and Providers.The website is provided "as is". To the extent permitted by law, Housing Hub does not give implied warranties of title, merchantability or fitness for purpose.Nothing in these terms excludes rights that cannot legally be excluded, including under the Competition and Consumer Act 2010 (Cth). Where the law allows, Housing Hub limits its liability for those rights to doing the service again or paying the cost of doing the service again.

INDEMNITY

Users agree to protect Housing Hub from third-party claims that arise from:
  • the user using the website
  • material the user provides.
This does not apply to the extent the claim is caused by Housing Hub fraud or negligence.Housing Hub will take reasonable steps to reduce its loss. A user liability will be reduced to the extent Housing Hub contributed to the loss.

CHANGES TO THESE TERMS

Housing Hub may change the website services or these terms at any time.If a user continues to use the website after the terms change, the user accepts the changed terms.

NOTICES

Housing Hub may send notices through a user account or by email.Notices to Housing Hub must be sent to support@housinghub.org.au.

ENDING ACCESS OR ACCOUNTS

Users may cancel their account or subscription at any time.Housing Hub may cancel access immediately for reasons including:
  • non-payment that is 30 days late
  • a material breach of these terms
  • insolvency or bankruptcy
  • death or dissolution
  • reasonable concerns based on complaints.
Termination usually takes effect at the end of the subscription term, unless Housing Hub ends access earlier for a material breach. Fees remain non-refundable.After termination, listings will be removed. Termination does not affect existing sale, tenancy or service agreements between users.Some terms continue after termination, including terms about the role of Housing Hub, intellectual property, limits of liability and indemnity.

GENERAL INFORMATION

These terms are governed by the laws of Victoria, Australia.If one part of these terms is invalid, it may be removed, and the rest of the terms will still apply.Housing Hub may assign its rights. Users need Housing Hub's prior written consent before assigning their rights.
